By accessing and using this service, you accept and agree to be bound by the terms and provision of this agreement.

If you do not agree to abide by the above, please do not use this service.

You must be 18+ (or the age of majority in your jurisdiction) to use the Service.

2. Service Description

Cretura is an artificial intelligence-powered image generation and creative sharing platform that provides the following core functionalities:

• AI Image Generation: Transform text descriptions into high-quality images using advanced GPT-4o technology (via third-party providers)
• Inspiration Gallery: Share, browse, and download user-created AI-generated artwork
• Content Moderation: Ensure platform content complies with community guidelines and legal requirements
• User Management: Secure account system and personal artwork management features

We reserve the right to modify, suspend, or discontinue any part of our service at any time, including but not limited to AI model updates, feature adjustments, or security policy changes.

3. User Accounts and Responsibilities

When you create an account with us, you must provide information that is accurate, complete, and current at all times.

Your Responsibilities

• Maintain accurate and up-to-date account information
• Keep your account credentials secure and confidential
• Comply with all applicable laws and regulations
• Be responsible for all activities that occur under your account

Prohibited Uses

• Use the service for any illegal or unauthorized purpose
• Transmit viruses, malware, or other harmful code
• Infringe upon intellectual property or likeness rights of others
• Attempt to gain unauthorized access to our systems
• Generate, share, or distribute NSFW content, adult/sexual content, pornography, violence, or other inappropriate material - strictly prohibited with zero tolerance
• Use celebrity, public figure, or other person's likeness for image generation without authorization
• Maliciously use AI generation technology to create misleading or fraudulent content

4. Payment Terms

Certain aspects of our service may require payment. You agree to pay all charges incurred by your account.

Pricing and Plans

Our current pricing plans are available on our pricing page. All subscriptions auto-renew monthly unless cancelled. We reserve the right to change our pricing with 30 days notice.

Billing and Payment

• Payments are processed automatically based on your selected billing cycle. Auto-renewal can be cancelled anytime before the next billing date
• Failure to pay may result in suspension or termination of your account
• You are responsible for all applicable taxes and fees. Additional charges may apply based on your location
• You can cancel your subscription anytime by self-service: go to Pricing → Manage Subscription, or click the Customer Portal link in your receipts. No need to contact support to complete cancellation. Cancellation becomes effective at the end of the current billing cycle.

Refunds

We offer a 7-day refund on first-time purchases only; used credits and prior recurring months are non-refundable. Cancellations take effect at period end and are not pro-rated unless required by law. You acknowledge that Creem, as MoR, may process refunds within 60 days to prevent chargebacks.

5. Intellectual Property Rights

The service and its original content, features, and functionality are and will remain the exclusive property of Cretura and its licensors.

We grant you a limited, non-exclusive, non-transferable license to use our service for its intended purpose.

You retain ownership of original image content generated using our platform. By sharing to the creative gallery, you grant us a non-exclusive license to display and distribute such content.

AI-generated content is created based on your prompts, and you may have usage rights to the generated results, subject to our content policies, applicable laws, and third-party rights that may apply.

You may not use our service to generate content that infringes upon third-party copyrights, trademarks, or likeness rights.

6. Service Availability and Support

While we strive for high availability, we do not guarantee uninterrupted access to our service.

We may perform scheduled maintenance that may temporarily affect service availability.

Support is provided during regular business hours through our designated support channels.

7. Termination

You may terminate your account at any time by following the cancellation process in your account settings.

We may terminate or suspend your account immediately, without prior notice, for conduct that violates these terms.

Upon termination, your right to use the service will cease immediately.

8. Disclaimers

The service is provided on an 'as is' and 'as available' basis without any representations or warranties.

We disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We are not responsible for any third-party content, services, or links that may be accessible through our service.

9. Limitation of Liability

In no event shall Cretura be liable for any indirect, incidental, special, consequential, or punitive damages.

Our total liability to you for all damages shall not exceed the amount paid by you to us in the 12 months preceding the claim.

10. Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of the jurisdiction where our company is registered.

Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

We encourage resolving disputes through direct communication before pursuing formal legal action.
